Thank you for visiting the MegaCloud™ website located at www.megacloud.com (the "Site"). The Site is an Internet Property of MegaCloud Ltd. ("MegaCloud™" "we" or "us"). MegaCloud™ is committed to protecting the privacy of our visitors’ personal information. We provide this MegaCloud™ Privacy Policy ("Privacy Policy") in order to explain our online information collection and use practices and the choices that you can make about the way your information is used by us. You agree to this Privacy Policy, in its entirety, when you: (a) access or use the Site; (b) become a Member; and/or (c) use the Services and/or Software (collectively, the "MegaCloud™ Products"). Capitalized terms not defined herein shall have the meaning set forth in the MegaCloud™ Website Terms and Conditions and End-User License Agreement ("Terms and Conditions"). Personal Information
We collect personal information when you attempt to become a Member, obtain access to the MegaCloud™ Products and/or otherwise choose to provide personal information to us. Personal information is any information that can be used to identify or locate a particular person or entity. The personal information that you provide to us may include, but not be limited to, all or some of the following: (a) your e-mail address; (b) your full name; (c) your credit card information or PayPal® information (depending on your preferred means of payment); (d) the e-mail addresses of your Authorized Users ("Authorized User E-mail Addresses"); and/or (e) any other information requested on the applicable registration form. For purposes of this Privacy Policy, item (c) in the preceding sentence shall be referred to as "Sensitive Information." We may also collect your personal information when you otherwise agree to the terms of this Privacy Policy, but do not complete the applicable registration process in full.

Use of Personal Information
We use your personal information to facilitate your use of the Site, in order to process your request for information regarding the MegaCloud™ Products and in order to facilitate your use of the MegaCloud™ Products. We also use your personal information (other than Sensitive Information or Authorized User E-mail Addresses) to send you information about MegaCloud™, our products and/or services and certain third party products and/or services that we think may be of interest to you. In connection with this, we use your personal information (other than Sensitive Information or Authorized User E-mail Addresses) to provide marketing messages to you by means of e-mail advertising, SMS text-based marketing (where and to the extent permitted by applicable law), telemarketing, direct mail marketing, pop-ups, pop-unders and/or online banner advertising.
Without limiting the foregoing, by submitting your telephone number at the Site, you agree that such act constitutes a purchase, an inquiry and/or an application for purposes of the Amended Telemarketing Sales Rule, 16 CFR §310 et seq. (the "ATSR"). With respect to the ATSR, and notwithstanding that your telephone number may be listed on the Federal Trade Commission’s Do-Not-Call List, MegaCloud™ retains the right to contact you via telemarketing in accordance with the terms of the ATSR.
Further, you agree that by submitting your personal information at the Site, you agree to receive mobile marketing including, but not limited to, text-message based marketing, from us (where, and to the extent that, such marketing is permitted by applicable law). As such, notwithstanding that your mobile telephone number may be listed on state and/or federal Do-Not-Call registries, we retain the right to contact you via text-message based marketing in accordance with applicable state and federal law.

Authorized User Email Addresses
The MegaCloud™ Products allow you to grant third-party Authorized Users access to your Cloud Files via an e-mail invitation containing your Cloud Log-In. In connection with the e-mail related process, Members shall input, and MegaCloud™ shall collect, the applicable Authorized User E-mail Addresses in order to facilitate the delivery of the underlying e-mail messages. In connection with the e-mail process, MegaCloud™ shall collect the applicable Authorized User E-mail Addresses for the sole and exclusive purpose of facilitating the delivery of the underlying e-mail messages. All Authorized User E-mail Addresses are collected and recorded on a non-personally identifiable basis, are kept strictly anonymous and are used only for the purposes of facilitating the MegaCloud™ Product-related services in accordance with end-user preferences.

Personal Information Sharing
As a general rule, and other than in connection with the limited exceptions set forth herein, MegaCloud™ will not sell, share or rent your personal information to or with others. Notwithstanding the foregoing, MegaCloud™ may, from time to time, provide such information on a limited basis to certain third-party administrative service providers in connection with: (a) your request for information regarding the MegaCloud™ Products; (b) your use of the MegaCloud™ Products; and/or (c) MegaCloud’s™ efforts to market certain offers to you. Any third-party so used has agreed to protect the confidentiality of information provided by MegaCloud™.
Further, MegaCloud™ reserves the right to share your personal information: (i) where you are in violation of this Privacy Policy and/or the Terms and Conditions; (ii) where MegaCloud™ determines, in its sole discretion, that such disclosure is necessary to protect the rights of MegaCloud™ and/or a third party, or necessary to protect MegaCloud™ from liability of any kind; (iii) if the information is subpoenaed; provided, however, that, where permitted by applicable law, we shall provide you with e-mail notice, and opportunity to challenge the subpoena, prior to disclosure of any Personal Information pursuant to a subpoena; or (iv) if MegaCloud™ is sold, merged or acquired; provided, however, that if MegaCloud™ is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on the Site of any change in ownership or uses of your personal information, as well as any choices that you may have regarding use of your personal information. The aforementioned includes exchanging information with other companies and organizations for fraud protection.

Non-Personal Information and Cookies
Cookies: The first time that a user provides an e-mail address in connection with his/her activities at the Site, we assign an identification number to that e-mail address and deploy a cookie ("Cookie") to the applicable user's PC (as defined in the Terms and Conditions). A Cookie is a piece of data stored on your hard drive containing non-personally identifiable information about you. To find out more about cookies, please visit www.cookiecentral.com. To disable and reject certain Cookies, follow the instructions associated with your Internet browser. Even in the case where a user rejects a Cookie, he or she may still use the Site; provided, however, that certain functions of the MegaCloud™ Products may be impaired or rendered inoperable if the use of Cookies is disabled.
Whenever that user comes back to the Site using the same PC, the cookie allows the Site to identify the user and to recall the user’s e-mail address. If, at any time, a user provides other information in connection with his/her activities on the Site (such as name, address, birth date, gender, etc.), we may store that information, along with the user's e-mail address, in our user database. We may use the information stored in our database: (a) to effectuate the purpose or transaction for which the information was originally provided by a user; (b) to pre-populate information fields in the event that the subject user wishes to purchase products and/or services or sign up for and/or subscribe to services, promotions or other offers in the future; (c) to ensure that a user will not be repeatedly exposed to the same advertisements, offers and/or promotions while visiting the Site; and/or (d) to, in connection with regular communication with a user, include offers, promotions or advertisements that were historically, or are likely to be, of interest to that user. We also use cookies to anonymously track and target the interests of our users to further enhance the Site experience.
IP Address: Each time that you visit the Site, our web server automatically recognizes your IP address and the web page from which you came. Your IP address is used to help identify you and to gather broad demographic information about you. We also use your IP address to help diagnose problems with our servers, to administer the Site and to better serve you in using the products, services and other features associated with the Site.
Action Tags: An action tag or a web-beacon (also known as a clear gif or a pixel tag) is a method used to track responses or actions of visitors who view certain advertisements or other information on the Site. Action tags are 1x1 pixel images embedded in a website page that are used to transparently collect information. We may use action tags to count the number of times that visitors click on a particular banner ad or visit the pages of the Site and to provide information about what products/services are viewed or purchased. We reserve the right to retain cookie and action tag data indefinitely. At no time will we share cookie-related, action-tag-related and/or generated information and/or data with third parties.

Use of Non-Personal Information
MegaCloud™ reserves the right to transfer and/or sell aggregate or group data about Site users for lawful purposes. Aggregate or group data is data that describes the demographics, usage or other characteristics of Site users as a group without disclosing personally identifiable information. Subject to applicable state and federal law, by submitting your personal information to, and/or using the Site, you agree to allow MegaCloud™ to transfer and/or sell such aggregate data to third-parties.

Third Party Websites
The Site may contain links to other third-party owned and/or operated websites. MegaCloud™ is not responsible for the privacy practices or the content of such websites. In some cases, you may be able to make a purchase through one of their third-party websites. In these instances, you may be required to provide certain information, such as a credit card number, to register or complete a transaction at such website. These third-party websites have separate privacy and data collection practices and MegaCloud™ has no responsibility or liability relating to them.

Minors
We encourage parents and guardians to spend time online with their children and to participate and monitor the interactive activities of their children. MegaCloud™ will never knowingly directly collect any information from individuals under eighteen (18) years of age. If MegaCloud™ obtains actual knowledge that it has collected information from an individual under eighteen (18) years of age, that information will be immediately deleted from our database.

Security
We endeavor to safeguard and protect our users’ information. The privacy of your personal information is very important to us. The servers that we store personal information on are kept in a secure physical environment. When our registration/application process asks users to enter Sensitive Information, and when we store and transmit such Sensitive Information, that information is encrypted and protected with SSL encryption software. While we use SSL encryption to protect Sensitive Information online, we also do everything in our power to protect all user information off-line and online. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, we cannot ensure or warrant the security of any information that you transmit to us, and you do so at your own risk.
All of our users’ information is restricted in our offices. Only employees who need the information to perform a specific job are granted access to personal information. Our employees are dedicated to ensuring the security and privacy of all user information. Employees not adhering to our firm policies are subject to disciplinary action. In compliance with applicable federal and state laws, we shall notify you and any applicable regulatory agencies in the event that we learn of an information security breach with respect to your personal information.
